ByteDance, the owner of TikTok, has decided to challenge the law that requires the sale or bans of the popular video platform in the USA until January 19. In a lawsuit filed in the Court of Appeals for the District of Columbia District, ByteDance claims that the move violates the US Constitution, including the freedom of speech guaranteed by the First Amendment.
Challenges to the sale
ByteDance highlights numerous obstacles to selling its US stake in TikTok. In their opinion, such a sale is neither commercially, nor technologically, nor legally possible. Moving source code and transferring knowledge to engineers will take a long time. Also, the Chinese government is unlikely to allow the sale of the referral engine that is key to TikTok's success in the US.
User data protection
The company claims to have spent $2 billion to protect the data of American users and agreed to additional commitments under a 90-page National Security Agreement developed in cooperation with the Committee on Foreign Investment in the United States (CFIUS). This agreement included the right of the US government to suspend TikTok's operations in case of breach of obligations.
